vouchID Terms of Use

1. WHAT'S IN THESE TERMS

dashboard, and website (together, the "Platform"). By accessing or using the Platform, you agree to these Terms and acknowledge that these Terms specifically limit vouchID’s liability and place ultimate responsibility for legal compliance upon you. If you do not agree, do not use the Platform.

2. WHO WE ARE

The Platform is owned and operated by vouchID Inc., a Delaware corporation ("vouchID," "we," "us," "our"). Contact: support@vouchid.co

3. PLATFORM SCOPE

The Platform provides age verification and related identity trust services. It may be accessed via API, SDKs, or dashboards. You may visit the website without an account, but access to API features requires registration.

4. ELIGIBILITY

You must be 18 or older to register or use the Platform.

Minors are not permitted to hold accounts.

Multiple accounts per person or organization are permitted.

5. FEES

Fees are payable only by platforms and enterprises, not individuals.

Fees are non-refundable under all circumstances.

Failed verifications do not incur fees.

6. VERIFICATION & DATA PERMISSIONS

All verifications are performed by utilizing third-party technology providers. vouchID maintains strict data segregation. We do not use your data for marketing, advertising, or commercial data brokering.

6.1 Audit Trails & Security: You acknowledge that vouchID retains secure Audit Trails (including IP addresses, device metadata, and verification logs) solely for the purposes of security monitoring, fraud prevention, and legal compliance.

6.2 Biometric Information Consent: By using the Platform, you explicitly consent to the collection, processing, and limited storage of your Biometric Data (such as face scans) by vouchID and its third-party providers for the sole purpose of identity verification and fraud prevention. You agree that this data is not sold or traded.

6.3. Data Reliance. You agree that all verification results, audit trails, and data provided by the Platform are solely for your internal use and are not intended to be a guarantee of identity, age, or compliance status. You bear the sole risk of relying on the outputs of the Platform.

7. INTELLECTUAL PROPERTY

vouchID owns all rights in the Platform, including software, databases, and documentation.

Limited use of documentation for integration purposes is permitted.

No other use is allowed without written permission.

8. ACCEPTABLE USE

You must not use the Platform to:

  • Commit fraud, impersonation, or bypass verification.
  • Submit false or stolen information.
  • Misuse account data or attempt to resell Platform access.
  • Engage in illegal or harmful activity.

We reserve the right to interpret prohibited behavior broadly.

9. TERMINATION

vouchID may suspend or terminate accounts at any time, with or without cause.

Users may delete their account at any time.

10. DATA PROTECTION

See our Privacy Policy for details. We comply with GDPR and CPRA principles. You, as the Platform user, are the Data Controller of all Personal Identifiable Information (PII) processed via the Service. You are responsible for obtaining all required user consents and ensuring your data collection practices comply with all applicable data protection laws. vouchID disclaims all responsibility and liability for your failure to meet your PII processing and regulatory obligations.

11. COMPLIANCE AND DISCLAIMER OF LEGAL ADVICE

11.1. Nature of Compliance Data. The Platform provides automated Age Verification Legislation Trackers, Compliance Mandates, Rulesets, and Automated Compliance Recommendations (collectively, the "Compliance Data"). The Compliance Data is provided for informational and configuration purposes only.

11.2. NO LEGAL ADVICE. vouchID is a technology and data service, not a law firm. Use of the Platform and the Compliance Data does not create an attorney-client relationship. The Services do not constitute legal advice, legal opinions, or legal counsel. You acknowledge and agree that vouchID has no duty to advise, consult, or provide legal interpretation regarding the laws, statutes, or regulations of any jurisdiction.

11.3. Client Responsibility. You are solely responsible for consulting with your own qualified legal counsel to interpret all Compliance Data and to determine the necessary actions required to ensure your legal compliance in all applicable jurisdictions. Your use of the Platform does not guarantee your compliance with any law or regulation.

12. LIMITATION OF LIABILITY AND WARRANTIES

12.1. Warranties. VouchID provides the Platform and its services, including the Compliance Data, "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. vouchID does not warrant that the Platform or the Compliance Data will be accurate, error-free, uninterrupted, or meet your specific compliance needs.

12.2. Exclusion of Damages. IN NO EVENT shall vouchID, its affiliates, directors, or employees be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages (including, without limitation, damages for lost revenue, lost profits, regulatory fines, penalties, loss of business opportunity, or business interruption) arising out of or relating to these Terms or the use of the Platform, regardless of the cause of action (whether in contract, tort, warranty, or otherwise), even if vouchID has been advised of the possibility of such damages.

12.3. Liability Cap. VouchID’s total aggregate liability to you arising out of or related to these Terms or the Services shall not exceed the total fees paid by you to VouchID for the Services giving rise to the claim during the three (3) months immediately preceding the date the claim arose.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless vouchID, its affiliates, officers, directors, and employees from and against any and all claims, demands, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • a) Your failure to comply with any applicable law, rule, or regulation, including any Age Verification laws;
  • b) Any fine, penalty, or regulatory action imposed by a governmental or regulatory body related to your use of the Platform or your operations;
  • c) Your reliance on or misuse of the Compliance Data without obtaining independent legal counsel;
  • d) Your breach of these Terms.

14. GOVERNING LAW

These Terms are governed by the laws of Delaware, USA.

Jurisdiction lies exclusively with courts in Delaware.

15. CHANGES

We may amend these Terms at any time by posting an updated version.

Continued use of the Platform 30 days after posting constitutes acceptance.

16. OTHER

We may assign these Terms without notice.

These Terms constitute the entire agreement between you and vouchID regarding the Platform.
